Terms of Use Effective as of April 24, 2024 Important Notice These Terms of Use (hereinafter referred to as the “Terms”) constitute a legally binding agreement between you (whether an individual, company, or any other entity) and Gesong (as described in the “About Gesong” section) regarding your use of this product (as defined in Article 1, Section (1) of these Terms). You must have reached the legal age of majority in your jurisdiction to access and enter into these Terms. If you have not reached the legal age of majority, your guardian must consent to or enter into these Terms on your behalf. Please read these Terms carefully before using your Gesong product. By using any Gesong product, you are deemed to have agreed to be bound by these Terms. If you do not agree to these Terms, please do not use any Gesong products. Subject to the applicable product return policy, you may return the Gesong product to the authorized store, distributor, or retail outlet where the product was originally purchased to request a refund. Please note that refunds through retail outlets may also be subject to the return requirements of such outlets. The product return policy shall comply with the relevant laws and regulations of the country or region of purchase. You may access a copy of these Terms at any time via the Gesong website and retain a copy for future reference. About Gesong If you are located in the United States, “Gesong” refers to Shenzhen Cedarobo Technology Co., Ltd. If you are located in China, “Gesong” refers to Shenzhen Gesong Technology Co., Ltd. If you are located in any other country or region, “Gesong” refers to Shenzhen Cedarobo Technology Co., Ltd. 1. General Provisions (1) Definition of Products The products referred to in these Terms include: Gesong devices and the software contained therein, including but not limited to code and other embedded software, documentation, interfaces, content, fonts, and any data protected by copyright owned by Gesong or its licensors; Any updates or upgrades to the products described in Item 1 above. (2) Applicability of These Terms Unless otherwise agreed, all software included in these Terms shall be governed by these Terms, regardless of whether such software is stored in read-only memory, any other media, in any other form, or downloaded from authorized online sources. 2. End-User Software License Subject to compliance with these Terms, you are granted a limited, non-exclusive license to use the software (as defined in Article 1, Section (1), Item 1) on a single Gesong device or computer. You may not sell, transfer, or use the software for any commercial purpose. 3. Your Obligations By using this product and agreeing to these Terms, you represent and warrant that: (1) Without prior permission from Gesong, you shall not use Gesong’s technology or intellectual property to develop software or design, develop, manufacture, sell, or license third-party devices or accessories related to Gesong products. (2) You may make one copy of the software for backup purposes and store it on a computer hard drive or other storage medium. However, you may not distribute or make the software available over a network such that it can be used by multiple devices or computers simultaneously. (3) Without prior written consent from Gesong, you may not sell, rent, lease, lend, sublicense, or distribute the software in whole or in part. However, you may permanently transfer the entire software license to another party in conjunction with the transfer of the Gesong device, provided that: The transfer includes the Gesong device and all software contained therein; You retain no copies of the software; and The recipient has read and agreed to these Terms. (4) Unless expressly permitted, you shall not and shall not allow others to misuse, intrude upon, or otherwise improperly use the product, including but not limited to modifying, decoding, copying, disassembling, publishing, publicly transmitting, reverse engineering, decompiling, extracting source code, disassembling, or creating derivative works of the software. (5) You further agree not to engage in the following activities: Copying or using any part of the product beyond the scope authorized by these Terms; Providing or allowing third parties to use all or part of the software without Gesong’s written consent; Using the product for fraudulent purposes; Removing any copyright notices from the product; Attempting to bypass, alter, disable, or evade any digital rights management system related to the product; Any other improper or unlawful activities. (6) When using the product for storage or copying, you must obtain authorization from the relevant rights holders in the applicable country or region. The copying function is limited to materials that are not copyright-protected, materials for which you hold the copyright, or materials you are authorized or legally permitted to copy. (7) If you choose to provide feedback related to the product, you grant Gesong an unrestricted, perpetual, irrevocable, non-exclusive, fully paid, royalty-free license to use such feedback for any purpose, including improving the product and creating new products and services. (8) You agree to comply with all applicable laws and regulations of the country or region in which the product is used. 4. Reservation of Rights Gesong and its licensors retain all intellectual property rights and interests in the product’s interface, graphics, design, firmware, software, services, and all other elements, as well as any rights not expressly granted to you under these Terms. 5. Privacy Policy Gesong’s Privacy Policy describes how Gesong collects and uses data. When you use the product, Gesong will collect data in accordance with these Terms and the Privacy Policy. Details can be found on the relevant website. 6. Usage Data (1) If you choose to help improve Gesong’s products and services, Gesong may collect anonymized device configuration data, application statistics, and error logs. (2) Data may be processed or transferred to affiliates or licensors located outside your country or region, where data protection laws may differ. (3) Data will be retained only as long as necessary for the purposes stated and in compliance with applicable laws. 7. Product Updates Gesong may provide updates including system software updates, model updates, bug fixes, and performance enhancements. Gesong commits to providing: At least five (5) years of software updates from product release; At least seven (7) years of security updates, and security patches throughout the product lifecycle when required. Failure to install updates may expose the product to security risks. 8. Product Services The product may provide access to Gesong and third-party services. Some services may vary by region or language and may require internet access and account registration. Services include but are not limited to: Bambu Cloud Model Recommendations Health Management System Print Result Detection Gesong does not guarantee complete accuracy due to technical limitations. 9. Third-Party Software Disclaimer Gesong products support standard G-code files but do not guarantee the compatibility or safety of third-party-generated G-code files. 10. Changes to These Terms Gesong may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms. 11. Termination and Survival These Terms take effect upon installation. Upon termination, Articles 6, 12, and 13 shall survive. 12. Disclaimer The product is provided “AS IS” without warranties of any kind. Gesong does not guarantee uninterrupted or error-free operation. 13. Limitation of Liability Gesong’s total liability shall not exceed the purchase price of the product, except where prohibited by law. 14. Technical Support Except as required by law or stated in the warranty policy, Gesong is not obligated to provide technical support. 15. Export Control You may not export or re-export the product without authorization under applicable laws. 16. Governing Law and Dispute Resolution These Terms shall be governed by the laws of the People’s Republic of China. Disputes shall be submitted to CIETAC arbitration in Shanghai, conducted in English. 18. Entire Agreement These Terms and the Privacy Policy constitute the entire agreement between you and Gesong regarding use of the product.
